Expungements
An expungement is a legal process by which a criminal conviction may be dismissed and a plea withdrawn. Expungements are useful for people trying to start a new chapter in their lives, say in boosting the credit score, applying for a new job, or seeking new housing.
In order to qualify for an expungement, the defendant must not have gone to state prison and have successfully completed probation and be free of new charges.
If the defendant was arrested for a crime but never prosecuted, OC Criminal Defense Attorney William Weinberg has been successful in filing petitions to seal and destroy arrest records. If the defendant was charged but never convicted, a Petition of Factual Innocence should be filed.
