Drug Charges
Drug Possession
Simple possession of narcotics is generally treated by the courts by referral to drug awareness or treatment programs. You should know that some of these offenses are "wobblers", that can be filed as a misdemeanor or felony by the District Attorney. Bill Weinberg has been very successful in having these cases treated as misdemeanors and getting his clients' cases dismissed outright.
Drug Sales or Possession for Sale
A good lawyer can help a client win a Possession for Sale case by doing his homework and commanding the facts better than the District Attorney. These cases frequently hinge on the following factors:
- amount of drugs
- packaging of drugs
- pay/owe sheets
- amount of currency
- pagers/cellphones
- scales
Someone charged with this offense can frequently have his case reduced to simple possession by knowing how to argue the facts of the case and expose the police bias in these cases. All too often the police decide right from the start that the suspect is a dealer, when really he is a user who needs treatment.
Manufacturing Drugs
These are typically referred to as "lab" cases, because they involved the manufacturing of methamphetamines on a small or large scale. These cases are very technical, and a comprehensive knowledge of the elements of the offense can produce excellent results for a client charged in such a case.
Bill Weinberg has had many victories in defeating lab cases by showing that the defendant did not possess "precursors" and thus did not have a lab in place. Contact my office for a full, confidential consultation on how to best defeat this type of charge.
