Fraud
Medical Insurance fraud is commonly committed by medical clinics that seek to fraudulently bill for services performed unnecessarily or not at all. Often these are prosecuted federally because the scope is quite wide and the acts require the use of communications across state lines. Medical Insurance fraud almost always involves Conspiracy, since so many persons are required to complete the crime.
Credit Card fraud is a very common type of fraud. The variety of crimes is limited only by the imagination of the criminal.
The most common type of credit card fraud involves simply using a stolen credit card or debit card at a retail location. Clients are frequently caught on video doing this and are easily prosecuted since the entire transaction is recorded.
Another, more sophisticated type of credit fraud involves doctoring the magnetic stripe on the back of the card to mimic another card, charging the maximum amount on the card. This involves the use of a “skimmer” to re-code the card. The accused will steal access cards or gift cards, do the recoding and then simply return the original card to the retailer. This has the effect of making the use of the stolen card almost impossible to catch, since there’s nothing “wrong” with the dummy card now being used.
The other more common type of credit fraud is widespread and occurs where a team will apply for credit at various retailers, charge the credit lines to the maximum, keep the merchandise and never pay their bills. These cards are using false or stolen ID. This crime is often called identity theft.
Insurance fraud is a crime committed where someone makes a false claim about the theft or damage of property. A very common occurrence is a person who has lost his or her job and has car payments that they cannot make. They arrange to have the car stolen and then make an insurance claim for the loss of the vehicle. Alternatively, there are cases where the owner of the car burns the car to get the insurance money. Unfortunately this results in a denied claim and also jail from being charged with arson and insurance fraud.
